Estate and probate
Selling an inherited luxury home.
For personal representatives, trustees and heirs: the paperwork, the house and the sale, handled in order.

The personal representative named by the court, or the trustee of a trust, signs the listing. Get the letters from the court or the trust documents first, then secure, insure and price the home.
Who signs.
The personal representative (with court letters) or the trustee.
Secure and insure.
Change the locks, keep the heat on, and tell the insurer the home is vacant.
Sort, sell, donate.
Heirs take what they want first. An estate sale company handles the rest.
Price and list.
A Smart Pricing Report sets the price from this year's comps.
What are the steps?
- Get authority. Letters from the court for a probate estate; the trust documents for a trust.
- Protect the home. Locks, utilities, vacant-home insurance and a weekly check.
- Value it. A Smart Pricing Report now, and a date-of-death value for your CPA.
- Sell it. Repairs only where they pay back. Many estate homes sell as-is.
What do heirs ask?
- Can one heir buy it? Yes, at a price the others accept. Put it in writing.
- Who pays the bills until it sells? The estate pays the mortgage, taxes, insurance and utilities.
- How long does it take? Probate timing varies by county court. Listing starts once the representative has authority.
- What about taxes? Inherited property takes a new tax basis. Your CPA confirms the numbers.
We are real estate agents, not attorneys or tax advisors. Talk to the estate attorney and a CPA before you sign.
Quick answers
Questions, answered.
Can we sell before probate closes?
Yes, once the personal representative has letters from the court. The representative signs the listing and the contract.
Do we have to clean out the house first?
No. You can sell as-is with the contents, or hire an estate sale company. We give you the vendor list.
