Discreet, fast, on your terms
Facing foreclosure on a $1 million home in Colorado? You have more options than you think.
Most Colorado owners of high-end homes have equity, and equity means choices: sell on your own terms, sell quietly, or short sell with your lender's approval. Here is the clock and the options, in plain English.

The short version
What can I do if my luxury home is in pre-foreclosure?
Act early: in Colorado you usually have about four months from the lender's notice to the sale date, and every week gives you more choices. If your home is worth more than you owe, a normal sale can pay off the loan and protect your equity. If it is worth less, a short sale needs the lender's approval. A sale on your terms almost always beats a forced sale at the Public Trustee auction. Talk to an attorney about your rights, and call us about the sale.
The clock
How long does a Colorado foreclosure take?
| Step | When | What you can still do |
|---|---|---|
| Notice of Election and Demand recorded | Day 0 | Sell, refinance or catch up. The clock has started. |
| Mailed notices from the Public Trustee | Within weeks | Read them; they list your sale date and your rights. |
| Notice of intent to cure | At least 15 days before the sale | File it if you plan to catch up the missed payments. |
| Public Trustee sale | 110 to 125 days after the notice | A sale or short sale must close before this date or the lender must postpone. |
Your options
What are my options if I am behind on a luxury home?
- Sell with your equity. Price the home to sell before the sale date, and the payoff happens at closing. You keep the difference. See what your home is worth.
- Sell quietly. A private, off-market sale to qualified buyers, without public marketing. See private luxury sales.
- Short sale. If you owe more than the home is worth, the lender may accept less. See luxury short sales.
- Cure or refinance. Catch up the missed payments by the cure deadline, or refinance if your equity and income allow it.
- Divorce or an estate. Many luxury foreclosures start with a divorce or a death. See selling in a divorce and estate and probate sales.
How we help
What does The Kenna Group do for an owner in foreclosure?
We price the home with a Smart Pricing Report, ask your lender for the payoff and the sale date, and build a plan that closes before that date: a quiet sale to our buyer network, a full launch, or a short sale package. One point of contact the whole way, and nothing about your situation goes in the listing. We are real estate agents, not attorneys or lenders; we will tell you when you need one.

Quick answers
Pre-foreclosure on a luxury home: questions, answered.
How long do I have before a foreclosure sale in Colorado?
The Public Trustee sets the sale 110 to 125 days after the lender records the Notice of Election and Demand, and sales are often postponed. You can usually still sell, refinance or cure until shortly before the sale.
Can I sell my house if I am in foreclosure?
Yes. If the home is worth more than what you owe, a regular sale pays off the loan and you keep the rest. If it is worth less, a short sale needs your lender's written approval.
What happens to my equity if the house sells at the Public Trustee sale?
If the sale brings more than the debts, the overbid goes through the Public Trustee to junior lienholders and then to you. A sale on your terms almost always nets more than a forced sale.
Will anyone know I am selling because of foreclosure?
The Notice of Election and Demand is a public record. How your home is marketed is your choice; a private or quiet sale is possible, and we never put your situation in the listing.
Should I talk to an attorney?
Yes. A Colorado real estate or bankruptcy attorney can explain your rights, the deadlines and options like a cure or bankruptcy. We help with the sale; we do not give legal advice.
General information, not legal, tax or lending advice. Rules and numbers change; confirm with the county, your lender or an attorney before you act.
